Terms & Conditions

• The promotion is open to all Starwood Preferred Guest® program members aged 18 and over excluding employees (and their immediate families) of Starwood Hotels & Resorts Worldwide, Inc., its affiliates, agencies or any other company or persons directly connected with the administration of the promotion. Proof of eligibility must be provided on request. If you are not a member of the Starwood Preferred Guest® program, you may open an account free of charge.
• Promotion is invalid where local regulations prohibit.
• To Enter: Starwood Preferred Guest® members must register for this promotion at www.starwoodafrica2010.com or by calling any of our call centers and mentioning registration code PFE between 00.00 Central European Time (“CET”) on June 8 2010, and 23.59 Central European Time on July 31 2010. The promotion period for participating stays runs from 00.00 CET on June 8 2010, at and ends 23.59 CET on December 31 2010.
• The Promotion: There are two parts to the promotion:
  a.Frequent stayer reward, as a thank you gift to our Starwood Preferred Guest® customers who make the most eligible stays in participating Starwood Hotels in the Africa & Indian Ocean region: The 3 customers making the most eligible stays at participating Starwood Hotels in the Africa & Indian Ocean region during the promotion period will be awarded with a bonus amount of Starpoints. The customer with the most eligible stays will receive 1,000,000 Starpoints; the customer with the second most eligible stays will receive 300,000 Starpoints; the customer with the third most eligible stays will receive 200,000 Starpoints. In the event of a tie on the number of eligible hotel stays taken, the time and date of the first stay will be used to determine the recipients, with the earliest first stay receiving the prize.
  b.Free prize draw: All registered Starwood Preferred Guest® customers making an eligible stay at a participating Starwood Hotel in the Africa & Indian Ocean region will be automatically entered into a prize drawing to win a bonus amount of Starpoints. The first prize winner will receive 50,000 Starpoints; the second prize winner will receive 30,000 Starpoints; the third prize winner will receive 20,000 Starpoints. One eligible stay will give the customer one entry into the prize draw; two eligible stays will give 3 entries; 3 eligible stays will give 5 entries; 4 eligible stays will give 7 entries; 5 eligible stays will give the maximum number of 10 entries. See below for a list of participating hotels. The list of participating hotels is subject to change at any time.
• A ‘stay’ is defined as a continuous series of nights at a given hotel. For example, three consecutive nights is one ‘stay’; or two non-consecutive single nights is two ‘stays’. To be eligible for the promotion, stays must be either (i) at a rate that qualifies for the awarding of Starpoints or (ii) result from the redemption of at a rate that qualifies for the awarding of Starpoints. Please note that certain rates (including, but not limited to, STARHOT, STARBIZ or bookings made through our partners) do not qualify for Starpoints, therefore would not be counted as eligible stays for this promotion.
• Winners will be informed by email on or around 1 February 2011 – please be sure to have provided a working email address so that we can contact you. If a winner does not respond to such notification within 7 days they will be disqualified and an alternative winner will be selected.
• You may enter the prize draw without making a purchase or booking a stay. To enter without making a booking or stay, send an email with your name, address & phone number to AFIO@starwoodpromotion.eu. Maximum of one email entry per person during the promotional period.
• Prizes are non-transferable, non-negotiable and no cash alternative will be offered. Prize winners are responsible for any applicable taxes associated with the acceptance of the prize.
• All entries must be made directly by the person entering the promotion. Entries made online by such methods as a macros, a script or the use of automated devices or processes are not allowed and all such entries will be disqualified.
• The Promoter reserves the right in its reasonable discretion to disqualify any entrant whose conduct is contrary to the spirit of the Terms & Conditions, or the intention of the promotion and to declare as void any or all of their entries based on such conduct.
• By participating in the Promotion, you hereby authorize the Promoter the right to collect, use, process, transfer and store all data provided by you, including without limitation, personal data, to the United States, or any location(s) throughout the world that the Promoter deems necessary, whether within your country of residence or elsewhere, and with such party(ies) as the Promoter deems appropriate, for purposes of administration of the Promotion. All information submitted to the Promoter as part of this Promotion will be treated in accordance with the Promoter’s privacy policy, available at www.starwoodhotels.com.  Personal information will be used to: (a) contact potential winners; and (b) if an entrant selects to receive additional information from the Promoter on the entry form, to send additional information to that entrant.  Entrants have the right to access, withdraw, and correct their personal data. • By participating in the Promotion, entrants agree to release and hold harmless the Promoter, its officers, directors, employees, affiliates and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or acceptance, receipt  use or misuse of any prize.  Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages.
• By entering the promotion, entrants agree to be bound by these terms and conditions and the decisions of the Promoter, which are final and binding in all respects. All instructions form part of the rules.
• The Promoter's decision is final and no correspondence will be entered into. The Promoter reserves the right to amend or withdraw any part of this promotion.
• Except where prohibited, participation in the promotion constitutes winners’ consent to Promoter’s use of winners’ name, likeness, voice, opinions, biographical information, and other personal information (the “Participant Information”), at Promoter’s discretion, for promotional purposes in any media whatsoever worldwide without payment or consideration. Promoter, at its election, and where lawful, may contact participant to obtain a publicity consent agreement in connection with Promoter’s use of Participant Information; provided however, that, unless otherwise required by law, Promoter’s failure to obtain a publicity consent agreement from participant shall not constitute a waiver, or otherwise bar Promoter from using Participant Information in the manner described herein.
• This promotion and these terms and conditions are governed by English Law.
